Terms of service

These Terms of Service ("Terms") govern your access and use of our website (the "Site") and services ("Services").

Our Services include the registration in the personal area of the Site, the sale of products and grooming services and the possibility to book our grooming services in our store in Milan. 

The provider of the Services is Bigli 6 SRL ("Bigli"), located at Corso Sempione 38 - 20154 Milan (MI), Italy, VAT number IT12299180963. You can request information from Bigli by:

Throughout the Site, the terms “we,” “us,” and “our” refer to Bigli. 

Our Site is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and grooming services to you. 

You are asked to print a copy of these Terms and store them on a durable medium.

 

Acceptance of Terms

By accessing our Site, using our Services and/or purchasing products or grooming services, you agree to comply with these Terms and our Privacy and Cookie Policy. If you do not agree, you may not access the Site or use any Services. 

 

Application of Terms

Any new features, applications or tools added to the Site will also be subject to these Terms. 

We may also, in the future, offer new Services and/or features through the Site (including the release of new tools and resources). Such new features and/or Services shall also be subject to these Terms of Service.

SECTION 1 - REGISTRATION ON THE SITE AND CREATION OF AN ACCOUNT

You can register and create an account to access a personal area of the Site.

Registration on the Site is free and it is not necessary for purchasing products or grooming services.

To register, you must complete the registration form, entering your name, surname, e-mail address as user id and password. Registration is confirmed by email sent to the address you provided. You are responsible for ensuring that the data is complete and truthful and that the information provided is always up to date. 

User id and password are confidential and cannot be transferred to third parties. You must notify us without delay in case of suspected improper use of user id and password. You can modify the user id and password, as well as list of addresses, by accessing to your personal area of the Site and for cancel your registration.

You can make a single registration in the personal area. 

In the event that we discover that the same user has made multiple registrations on the Site, we reserve the right to block the relevant account and/or cancel the multiple registration. The user will receive an email with notification of the deletion of the multiple registration account.

We reserve the right to refuse, at our sole discretion, the registration of any user who appears to be in violation of the applicable legislation, of these Terms or for security reasons.

We reserve the right to monitor users' purchasing process with the sole purpose of verifying and/or intercepting any violations and/or abuses.  In the event of any violation of the Terms and the applicable laws, we will have the right to terminate the Services, upon written notice.

 

SECTION 2 - ONLINE STORE TERMS 

Eligibility

Only customers of legal age within the EU can purchase products and grooming services. Certain grooming services and products, as indicated in our Site, are only available in our Milan store. Check regularly our Site to see availability of our products and new opening of our store worldwide.

You are defined "consumer user" if you are a natural person who, in relation to the purchase of products, act for purposes unrelated to any business, commercial, craft, or professional activity they may carry out. 

You are defined "professional user" if you are a professional, meaning natural or legal person acting in the exercise of your business, commercial, craft, or professional activity, or your intermediaries and you purchase with invoice and VAT number.

If you purchase products on the Site as a professional user, the provisions in the section 10 -on legal warranty for damaged and defective products- and in the section 11- Right of Withdrawal - ruled according to the Legislative Decree 6 September 2005 n. 206 ("Consumer Code") will not apply.

General representations and liability

By agreeing to these Terms, you confirm that you are of legal age in your state of residence. Bigli is not liable for purchases made by minors who provide false information.

Products are intended for personal use only, not for resale, even if you are a professional user. You confirm that you are not a dealer, reseller or distributor of our products.

In case of specific allergies or intolerances, you must read the ingredients of our products and contact Bigli directly to verify that the products sold by Bigli are suitable for your health. Bigli is not responsible for unsuitable purchases to your health.

You do not use our products for illegal purposes or violate any laws. 

A breach or violation of any of the Terms will result in an immediate termination of your Services.  

Rights of Bigli

We reserve the right to limit the sales of our products or grooming services to any person in regions or jurisdictions not included in the Terms.

We reserve the right to refuse any order you place with us. 

We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. 

In particular, we reserve the right not to accept purchase proposals and to cancel orders that do not provide sufficient guarantees of solvency or if anomalies are found in the transactions and in the means of payment used.

In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. 

We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

 

SECTION 3 - PRODUCTS OR SERVICES 

Characteristic of products and grooming services

Products and grooming services are described on the Site but exact colour and image representation are not guaranteed, with particular regard to dimensions and/or the chromatic aspects of the products and/or packaging. 

Availability 

Certain products or grooming services may be available exclusively offline in our store in Milan, Italy. These products or grooming services may have limited quantities and are subject to return or exchange only according to refund conditions of the store where the products or grooming services were purchased.

We reserve the right to limit the quantities of any products or grooming services. 

No Warranty

We do not guarantee that our products or grooming services will meet your expectations. 

 

SECTION 4 - MODIFICATIONS TO THE PRODUCTS, SERVICE AND PRICES 

Price 

All prices of the products and grooming services are clearly indicated on the Site and are inclusive of VAT. Delivery costs are properly highlighted at the time of ordering. The cost of each shipment may vary depending on the delivery and payment method, as well as the destination and the total amount of the order.

Price Changes

Prices for products and grooming services are subject to change without notice. 

Product and grooming service changes 

We reserve the right at any time to modify or discontinue the products and grooming service, without notice at any time. 

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Services. 

 

SECTION 5 – PURCHASE AGREEMENT 

Submit a purchase order

In order to submit a purchase order for one or more products or grooming service on the Site, you must fill out an electronic order form and transmit it electronically to our online store, following the instructions on the Site.

Order Confirmation

When we accept and confirm the purchase order, we execute our purchase agreement for products or grooming services.

Each purchase order is confirmed when we display an order number and the order summary on the Site and send you via email to the email address entered during the submission of the purchase order or provided during the registration on the personal area of the Site. You must use the order number to identify the order in any communication with Bigli.

Order Review 

You undertake to verify the correctness of your order summary and notify us of any errors promptly. Possible additional costs caused by your errors in the indication of data and not reported in a timely manner, will be charged exclusively to you.

You can review and change each order on the Site by contacting Bigli's customer service, immediately after sending the order.

It is possible that there may be occasional unavailability of the products offered, in which case, if the products chosen by you are not available, in whole or in part, the purchase order will not be processed.

 

SECTION 6 - ACCURACY OF BILLING AND ACCOUNT INFORMATION 

Accuracy

You agree to provide current, complete and accurate purchase and account information for all purchases.

You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

 

SECTION 7 -PAYMENT - DISCOUNT COUPONS – PROMOTIONS 

Payment

Payment for the products and grooming services purchased is made by credit card and/or other means of payment as indicated on the Site.

The accepted credit cards are: Visa, Mastercard, Maestro, American Express, UnionPay. The other method of payment are: Shop Pay, Apple Pay, Paypal, Bancontact only available in Belgium and iDEAL, only available in Netherlands.

All data is transferred in encrypted form using an SSL certificate and is therefore not visible to external parties. In addition, the data is entered directly on the bank's website, thus ensuring maximum security. 

Discount coupons or promotional codes

Any applicable discount coupons or promotional codes can be entered by you when filling out the purchase order in the "Shopping Chart section". The system will update the total amount of the order net of the value of the voucher.

The discount voucher can be combined with other commercial initiatives only in the cases in which it is expressly indicated.

 

SECTION 8 – SHIPPING AND DELIVERY

Courier

We ship our products in EU with DHL Express, for the fastest & most reliable service to suit you. 

Delivery

Delivery times will vary depending on the destination and the terms indicated at the time of the order will in any case have indicative value.

All taxes and customs duties are handled by us, so there will not be any unexpected charges upon delivery. However, Bigli cannot be held responsible for delays incumbent on suspension of service of our carriers as well as customs procedures for shipments abroad.

The following shipping fees applies depending on the territory of delivery:

Italy, Austria, Belgium, Cyprus, Denmark, Estonia, Finland, France, Germany, Greece, Ireland, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Portugal, Slovakia, Slovenia, Spain, Sweden, Monaco, San Marino, Vatican City: for purchase order under 150 euro, a shipping fee of 9,90 euro apply. You can enjoy complimentary delivery on all orders over 150 euro.

For Norway and Switzerland, a shipping fee of 9,90 euro applies for purchase order under 150 euro, for purchase order above 150 euro, the 15,00 euro shipping fee apply.

All orders received from Thursday PM to Sunday PM are dispatched on the following Monday. We do not ship on Bank Holidays. Please bare this exclusion in mind when placing your order, especially if it is time sensitive or intended for a special occasion.

Once your order has been shipped, you will receive a confirmation email containing the shipment details and a tracking number so that the shipping progress of your order can be tracked.

Non-Delivery

In case of non-delivery due to the absence of the recipient at the specified address, the courier will send you an email warning and will attempt a new delivery. 

If it is impossible to make the new delivery due to the absence of the recipient, Bigli's customer service will try to contact you to schedule a further delivery. In the event that Bigli's customer service is unable to contact you for the next 10 days or in the event of further impossibility of delivery due to the absence of the recipient, the products ordered will be returned to Bigli.

The termination of the purchase order and the refund amount will be communicated to you by email. The refund amount will be credited to the payment method used for the purchase. 

Bigli is not responsible for the methods and timing of the release of funds by the credit institutions, owners of the payment systems used by you to place the order.

Your duty to check the products 

At the time of delivery of the products you are required to check: a) that the tear strip of packaging is intact and the packaging is not damaged or otherwise altered; b) that the number of pieces delivered corresponds to that indicated in the transport document.

Any damage to the anti-burglary label, packaging and products or the mismatch in the number of pieces/packages or indications must be immediately reported through customer service at support@eredizucca.com and specifying the order for which such errors occurred.

 

SECTION 9 – FORCE MAJEURE

Cases of force majeure (such as, but not limited to, supervening legal provisions, regulations and other measures of the Public Authority, wars, embargoes, fires, floods, explosions, earthquakes, floods, epidemics, strikes, etc.), unavailability of means of transport, as well as unforeseeable or unavoidable events that cause a delay in deliveries or make them impossible or cause a significant increase in the cost of delivery to be borne by Bigli, will give the right to postpone or cancel, in whole or in part, the scheduled delivery or to terminate the purchase order. 

In such cases, Bigli will provide you with timely and adequate communication to the e-mail address and the refund of any price already paid.

 

SECTION 10 – DAMAGED AND DEFECTIVE PRODUCTS 

The Products offered on the Site comply with national and EU legislation. 

All products sold on the Site are covered by the legal warranty ("Legal Warranty"). 

Upon delivery, you must examine the products to ascertain their correspondence to the order, quantities, and agreed qualities, also verifying any apparent defects.

If you are a consumer user:

According to Consumer Law, Bigli is liable for any conformity defect existing at the time of product delivery and manifesting within two years of delivery. 

The conformity defect must be reported to Bigli by sending an email to support@eredizucca.com. The action to enforce the defects is prescribed, in any case, within twenty-six months from the delivery of the products.

Unless proven otherwise, it is presumed that the conformity defects manifesting within one year of product delivery already existed at that date, unless this assumption is incompatible with the product's nature or the conformity defect's nature. To benefit from the Legal Warranty, the user must therefore provide proof of the purchase date and delivery of the goods.

In case of a defective product, you have the right to restore conformity, receive a proportional price reduction or terminate the purchase agreement based on the Consumer Code. For the purpose of restoring product conformity, you can choose between repair and replacement, provided that the chosen remedy is not impossible or, compared to the alternative remedy, does not impose disproportionate costs on Bigli, considering all circumstances and, in particular, the following: a) the value the product would have without the conformity defect; b) the extent of the conformity defect; and c) the possibility of implementing the alternative remedy without significant inconvenience to you. Alternatively, you have the right to terminate the purchase agreement or reduce the price. 

In case of contract termination, Bigli will refund you the price paid, including shipping costs. In case of price reduction, Bigli will refund the amount of the reduction previously agreed with you. 

If you are a professional user:

The provisions of Articles 1490 et seq. of the Italian Civil Code apply.

In the event any product is damaged or defective, you will be entitled to refund provided that you immediately report to Bigli, within the following 8 (eight) days from the delivery of the product, any defect or discrepancy of the product from the purchase order with a specific description. After this term, the sale is considered accepted without reservations, with the consequent waiver of any defect claims. Any hidden defects not detectable upon delivery must be reported, under penalty of forfeiture, within 8 (eight) days from discovery in the same manner as for apparent defects.

The conformity defect must be reported to Bigli by sending an email to support@eredizucca.com.

For both consumer and professional users

Products repaired, modified, or otherwise altered by the user are excluded from warranty. Also excluded from the scope of the warranty are any malfunctions or other defects caused by accidental events or user responsibility or use of the product not conforming to its intended use and/or as provided in the technical documentation attached to the product, where existing, or the product's usage instructions.

Refund

We will arrange refunds after inspecting and evaluation of the damaged and defective products and upon written confirmation.

The refund amount will be communicated to the user via email and credited to the payment method used for the purchase.  

We shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we have inspect or evaluate the product.

 

SECTION 11 – RIGHT OF WITHDRAWAL 

You have the right to withdraw from the purchase order within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire physical possession of the products.

To exercise the right of withdrawal, you must inform us of your decision to withdraw by a written request at support@eredizucca.com.

Effects of Withdrawal

If you withdraw from your purchase order, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw. 

We will reimburse you the price paid for the products, including the costs of the return shipping, using the same means of payment used for the purchase order. We are not responsible for delays in crediting, depending on the bank or type of credit card used for payment.

We may withhold reimbursement until we have received the products back to us.

Return

You shall send back the products, without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from the purchase order to us. 

We accept returns if the item is unused and in its original condition.

For hygiene reasons, cosmetics products cannot be returned if unwrapped or unsealed unless faulty.

Please note that returns will need to be sent to Italy. If your return is accepted, we’ll send you a return shipping label, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.

We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not within 14 days from the return of the product in our warehouse based in Milan. 

 

SECTION 12 – COMMUNICATIONS AND COMPLAINTS

All communications or complaints against Bigli regarding purchase orders, refunds or returns must be sent by email to support@eredizucca.com.

 

SECTION 13 – INTELLECTUAL PROPERTY RIGHTS

Ownership

All trademarks (registered and unregistered), as well as any and all intellectual works, distinctive signs or names, images, photographs, written or graphic text and, more generally, any other intangible asset protected by laws and international conventions on intellectual property and industrial property ("IP Rights"), reproduced on the Site remain the exclusive property of Bigli and/or its assignors,  without any rights to the same deriving from access to the Site and/or the signing of a purchase order. 

Unauthorized use

Any use, even partial, of the IP Rights is forbidden without the prior written authorization of Bigli, in favour of which all related rights are reserved.

You agree to not reproduce, duplicate, or exploit any part of the Site and the Services without our written permission.

 

SECTION 14 – OPTIONAL TOOLS 

Third-party tools and application

We may provide you with access to third-party tools or application, for instance for booking the grooming services or accessing to social media, over which we do not have any control. 

You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. 

Risk and liabilitiy of third-party tools

We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. 

Any use by you of the optional tools offered through the Site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). 

 

SECTION 15 – THIRD-PARTY LINKS 

Certain content, products, grooming service and Services, including payment services, available via our Service may include materials from third-parties. 

Third-party links on this Site may direct you to third-party Sites that are not affiliated with us. 

Risk and liabilitiy of third-party links

We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or sites, or for any other materials, products, or services of third-parties accessible from third party links.

We are not liable for any harm or damages related to the purchase or use of goods, grooming services or services, resources, content, or any other transactions made in connection with any third-party links and sites. 

Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. 

Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party. 

 

SECTION 16 – USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS.

Rights

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us, you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, 'comments'), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any media any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments. 

Contents removal

We may but have no obligation to remove content that we deemed unlawful or offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service. 

Your Content responsibility and liability

You are solely responsible for any comments you make on our Site and social media pages and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party. 

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related Site. 

You may not use a false e‑mail address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments.

All personal data will be processed by Site in accordance with the relevant legal provisions, in particular those on the protection of personal data. Credit card information is always encrypted during transfer over networks.

Occasionally there may be information on our Site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability.

We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information if any information in the Service or in the Site is inaccurate at any time without prior notice.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, the remaining provisions remain in effect. 

 

SECTION 23 – TERMINATION 

These Terms of Service are effective unless and until terminated by either you or us. 

You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our Site. 

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term of these Terms of Service, we may immediately terminate this agreement at any time and/or accordingly may deny you access to our Services. 

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. 

 

SECTION 24 – ENTIRE AGREEMENT 

These Terms of Service and any policies or operating rules posted by us on this Site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service. 

 

SECTION 25 – GOVERNING LAW, JURISDICTION AND DISPUTE RESOLUTION PROCEDURES

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Italy and the applicable EU laws.

If you are a consumer user:

  1. For any dispute regarding the application, execution and interpretation of the Terms, the court of the consumer's place of residence or domicile shall have jurisdiction.

  2. Pursuant to art. 14 of Regulation 524/2013, you can submit a complaint to the European Union ODR platform which can be reached at the following link http://ec.europa.eu/consumers/odr/

  3. According to article 49 paragraph 1 letter V of the Consumer Code you can submit a compliant to the Joint Conciliation procedure. You can start the procedure if, after 30 days from the notification of a complaint to Bigli, you have not received a response or you have received a response that is not satisfactory.

Bigli reserves the right to update or modify the Terms and Conditions at any time and you can review the most current version of the Terms of Service on this page. Your continued use of the Site following the posting of any changes, constitutes acceptance of those changes.
